Feinstein finally does the right thing, and the Dems have eliminated telecom exec immunity from FISA bill: Californians I know have been in shock that Sen. Dianne Feinstein, known for her great record on civil rights, was for granting immunity to telecom executives as part of the new FISA bill. She has reversed, and majority leader Harry Reid’s aides have confirmed that immunity has been stripped out of the FISA bill.

Bush has dishonored his gentleman’s agreement with Reid on recess appointments, and Reid has stuck it to him (WTG, HARRY!): Last summer, Reid and Bush made a deal that Bush wouldn’t pull his recess-appointment stunts. Bush, typically, didn’t live up to the agreement. Last night, with regular “Broken Government” guest John Dean, Keith Olbermann discussed Reid’s threat to keep the Senate in “pro forma” session through Thanksgiving weekend. Now comes the first word that Reid is going to do it — and this is “breaking news”:

THE STATEMENT of Harry Reid, reported on AmericaBlog:

The Senate will be coming in for pro-forma sessions during the Thanksgiving holiday to prevent recess appointments.

My hope is that this will prompt the President to see that it is our mutual interests for the nominations process to get back on track.

While an election year looms, significant progress can still be made on nominations.

I am committed to making that progress if the President will meet me half way.

But that progress can’t be made if the President seeks controversial recess appointments and fails to make Democratic appointments to important commissions.

As Democratic leader, I recommend nominees to the President for many important commissions like the Federal Communications Commission, Federal Energy Regulatory Commission and the Nuclear Regulatory Commission.

These independent agencies are required by law to have Democratic representation.

As a result, the President has a statutory obligation to honor my recommendations and move on them in good faith.

And, up until recently, the President has generally discharged that obligation.

In the last several months, however, the administration has been stalling progress on Democratic appointments.

This problem existed before the August break.

In an effort to solve it, I worked hard to confirm over 40 administration nominees in exchange for a commitment by the President to make progress on a number of important commissions.

When we reconvened after August break, I also worked to quickly move on the President’s new Attorney General.

I did this despite my own opposition to that nominee.

Even with all this hard work on our side, the commitments the administration made to me before August break were not met.

In the almost three months since that break, we have received no Democratic nominees to full-time commission positions.

For some, in fact, absolutely no discernable progress has been made.

With Thanksgiving break looming, the administration informed me that they would make several recess appointments.

I indicated I would be willing to confirm various appointments if the administration would agree to move on Democratic appointments.

They would not make that commitment.

As a result, I am keeping the Senate in pro-forma to prevent recess appointments until we get this process back on track.

NO KIDDING! It is awesome … can’t wait for Olbermann tonight. He’ll have more on this.

BTW / OT: The last two nights, Olbermann has done superb reporting on the whole history of Rudy Giuliani and FOX News, and why Fox News is beholden to him. (in a nutshell: WIthout Rudy’s threats to Time-Warner cable to carry the new network in 1996, FOX News would not exist today. For the WHY, read both of Olbermann’s transcripts — Wednesday and Thursday.

The shenanigans that Fox News is currently pulling against all the GOP candidates, except Rudy, are really something … read the Thursday transcript for that tawdry story. (And, if we had a functioning FCC, I would think that it would merit an investigation.)

IF Harry of Nevada can keep his word….on this and the 50 billion.

Senator Russ Feingold stated during a radio interview recently that the Senate Intelligence Committee only had 3 senators who voted not to give immunity to the Telco’s. Wonder when it was changed after being voted of the Intel Committee. Was that in the Judiciary committee it was changed?

Senator Feinstein and Rockefeller IV voted for granting immunity stating that it would be wrong to hold the Telco’s to account for a “lawful” governmental request. It makes me wonder why Rockefeller kept a “CYA Note to self” addressed to the now current CIA director in a safe for so long.

Is not the former CEO of Quest having legal issues for saying no?

The irony is that we have been conducting this type of surveillance for years on Americans on American soil; legally or not. A US person is a mythical creature to some folks these days.

I’ve never heard of a recess appointment without a recess. If it were attempted, it would be called something else. It sounds like it would be an attempted bypass of the Constitution, which courts would likely derail.

If your cat had kittens in the oven, you wouldn’t call them bisquits.

Sorry, as Dollar Bill O’Reilly says, “Not buyin’ it.” Besides, Matt Damon has been in too many spy movies. For Larry I’d nominate TOM HANKS for his authenticity as the quinticential American. Another possibility would be Dustin Hoffman, another authentic everyman.

The thing you DON’T want to end up with, is someone like Matt Damon appearing in the film and the audience going, “Hey look, it’s Matt Damon earning his $100 million!” With an actor like Hanks or Hoffman they’ll go, “Hey look, it’s Larry Johnson. Wow, I feel that he’s on MY side and I’m certainly on his.”

Thought i’d cheer everyone up abit..
I sent that Calendar of the Bush Countdown ( available at Wal-mart..who knew?) to Jordan in Iraq..He hung in up and he said they love it..

Sorry to hear prcherlady is sick..I saw you posted her address briefly on this thread..probably a good idea to delete it quickly..There are some wack jobs out there.. I wish her well.. We had exchanged email addresses about 10 days ago.. On Tuesday i deleted 10,000 emails from my account and accidently deleted her email.. So Susan when you email her tell her to get better for me would you?

There is alot of discussions on some of the Winger blogs this morning about last nights debate and wondering why no one said we were winning in Iraq? very perplexing to them..
WINNING WHAT??? Look at the ME..it’s ready to explode from innumeral issues in every single area and they think a few less deaths to our brave men and women is WINNING? They think we want to lose..
Well find me the guy in Iraq that’s supposed to sign the surrender document that we are fighting against.
If you can answer that question then at least we have a chance of finding out who we are fighting against this week.
We are just inflaming the whole area..Instead of surging and purging..maybe we should pull back and let the situation cool down and let the iraq gov’t govern….

We are going to a party at the Elks club Saturday night for some friends that are sending thier son to Iraq..We did the same for Jordan..
This way all the friends and family can get together and wish him well..and raise a toast to his safety and bravery…I know his parents will need some real comfort, friendship and support in the coming days.

Apparently the Senate Judciary Committee actually ended up voting to send the bill, which does not specifically rescind Telecom immunity, to the full Senate for floor debate.

Thanks Nellie for the clarification on what was going on….I did not think the Judiciary made that change. I am surprised at Sen Whitehouse though. So the House and Senate are divided on this aspect of the FISA bill and even if it got to conference it is doughtful the House would prevail. Last hope is Dodd. Then you have to wonder what Harry will do if Dodd puts a hold on it. Tick Tock.

I am so tired of the Constitution being kicked like a rented mule.

I’m not a fan of Mitt Romney, but this stinks — and I hope some reporter finds out who in the hell is behind this:

Mysterious anti-Romney push-polls are being made in New Hampshire and Iowa. All campaigns deny being responsible. On local radio, an Iowa state representative describes the call. McCain is discussed positively on the call, but McCain called for an investigation.

Does it strike anyone else as strange that this would be the firm hired to make anti-Mormon phone calls?

And I’ve seen a few references to Romney by his proper given name, Willard Romney, which I personally prefer. Makes him sound a little nerdy, and a little less “folksy”, which he is anything but in real life.

So it’s Willard Romney to me from here on out. Suggested for your general use - the man is such a transparent phony in any case that demeaning him ought to be a requirement of citizenship.

FWIW - My wife called Reid’s office today, and an office aid told her that it applies to the weekend, but it’s undecided as yet as to whether they will do it on Thanksgiving.

Re Barry Bonds, At least he didn’t have Lasik surgery to augment his vision geez what an incredible hitter he would have been if he had just gone under the lazer. And luckily he never needed Tommy John surgery for ruined ligaments or tendons or whatever … can you imagine the arm strength he would have had if he had just gotten some unnecessary tendon enhancement surgery. And I surely do hope he did not indulge in vitamin therapy to avoid the effects of aging. Vitamin C, D, E, A and the B series could have had a really pronounced chemical effect on his already superhuman abilities.
Re Senator Feinstein, She and her husband make quite a nice annual income from the continuation of the Iraq war. Do you vote against your income?
Re Recess appointments: Fool me once shame on you … fool me twice won’t get fooled again or some such philosophy expounded to the dems not so very long ago.
Re the Romney calls, The stink benefits romney … cui bono? If not Mitt, then one of his supporters. Think of it as a beneficient borrowing from the create an anti-semite theory of debate. Susan, this is the kind of ploy designed specifically for good people such as yourself. If it’s McCain sponsoring the calls, it’s heinous and anti religious and evil. What is it then if it is Romney sponsoring the calls. German troops dressed in polish uniforms attacked german bases on the polish border … nice way to gin up a war with Poland. You can ask Larry, it is one of the more shopworn tricks of the trades.

Hi Everyone… glad to see you have been keeping things interesting while I was gone. I’ll tell all in a minute, as this is Friday Rant Open Thread…

God, what a past month, on every front. I got that virus, which then attacked my immune system, then pneumonia… 5 courses of antibiotics, respiratory support, and finally seem to be on the mend. Got home, and have been resting a lot, trying to read everything important you have all written… doubt I will catch up before another week… am having nurse come in for a little while till I am stronger, but at least I can breathe again. Feeeling stronger every day, now. Be careful out there, and carry hand sanitizer with you, and tissue… I also bought 2 R100 air filtration masks to wear if I go into any crowded areas, or areas with chemicals/dust particles… don’t block out everything, but are good enough for hospitals to help prevent SARS…

Finished Val’s book, still have Rozen’s comments to finish tonight. I was really impressed. It flows, and is an amazing first work… hope she will write more in the future… Best comment… ‘just because you’re paranoid, doesn’t mean they aren’t out to get you.’ SO TRUE!!! Val and Joe are truly Patriots, and I thank God for their love and service to this country. I pray they will continue to be strong, and will know that there are many of us out here that are hanging on, because of their bravery… Bless them both.

Didn’t see the debates, don’t think that there could even be a debate with 7 or 8 people… never could work. teams maybe, but debate has to be back and forth, not stupid, non-sensical sound bites… I read with interest Brent Budruski’s article on the Hill… http://pundits.thehill.com/2007/11/16/if-democrats-chose-gore-and-republicans-chose-hagel/#more-2116 In it, he does a pretty great job of talking about the debate, as well as Gore’s decision not to run for President. You might find it interesting too …

LOTS of issues about Veterans… won’t list them all, am too tired, but 120 suicides a week, desertion rates up highest since 80’s… forced redeployments, and redeployments, homelessness, joblessness, PTSD, lack of medical care… the list goes on and on and on. It truly makes me ill. Dear God, will someone please wake the sheeple up??? What must be done, and where should I start??? I will do whatever I can… We must not delay. Save a Soldier. Fight for him, who fought for you… Don’t let them be forgotten.

You are so right. Val and Joe Plame/Wilson have given us hope that there are true and honorable patriots within our government institutions. Many Americans are right behind them.

If the right wing radical neo-cons can be knocked out impeached sent to Siberia…something our nation can move back to the middle. It is far too late for the majority of the Iraqi people, they have been the victims of these blood thirsty, regime change radicals.

10,ooo pound gorilla sitting on the stage at the Democratic debate. The 8th Democratic debate and not one question asked about the Israeli Palestinian conflict. Governor Richardson was brave enough to bring up the topic, but all of the other candidates and Wolf Blitzer ran as fast as they could from the territory. Anyone else notice this?

How are the candidates assigned spots? Why is it that Hillary is always close to the center? They had John Edwards way out on the far right on the stage. So tired of the media trying to decide which candidates we will vote for.

Edwards has been ripping but the MSM sure tries to toss him off the bus. Just what do they have against him? If I were him I would keep pounding on Hillary’s yes vote for the Kyl Lieberman amendment. How many times can she make the same mistake? 2002 war resolution vote, and then a yes vote on the Kyl Lieberman amendment. When will she learn?

Also noticed that Wolf Blitzer interrupted John Edwards more than anyone else. Always tried to cut him off.

WAYNE BARRETT: …everything that Giuliani is saying about his expertise — he now calls himself an “expert” on terrorism, who’s been studying it for thirty-five years. And he claims things like when he went to Pat Robertson’s university, Regent University, he said, “bin Laden declared war on America, but nobody heard him. But I heard him. I understood what he was saying.” Well, in the testimony, Rudy says the opposite. He says that the first time he ever had a briefing on al-Qaeda was after 9/11. He describes the briefing in great detail. It was given by Yossef Bodansky, who wrote a book that came out on bin Laden in 1999, incidentally entitled The Man Who Declared War on America. But he read it after 9/11, and he underlined it with –

But “it was a mistake for me not to.”

Well, if Giuliani was paying attention to “Islamic terrorism” [his words] before anyone else was…why then did he ignore the 1993 WTC attack, which immediately preceded his 1993 election? In fact, the bombing and terrorism never came up in Giuliani’s taped meetings with city officials. Why did he put his headquarters in the WTC and a huge potential gasoline bomb underneath building 7? Why didn’t he equip first responders with decent communications devices?

Army Says Innovation Will Be Rewarded

The Army has summoned the top U.S. commander in Iraq back to Washington to preside over a board that will pick some of the next generation of Army leaders, an unusual decision that officials say represents a vote of confidence in Gen. David H. Petraeus’s conduct of the war, as well as the Army counterinsurgency doctrine he helped rewrite.

The Army has long been criticized for rewarding conventional military thinking and experience in traditional combat operations, and current and former defense officials have pointed to Petraeus’s involvement in the promotion board process this month as a sign of the Army’s commitment to encouraging innovation and rewarding skills beyond the battlefield.

“It’s unprecedented for the commander of an active theater to be brought back to head something like a brigadier generals board,” said retired Maj. Gen. Robert Scales, former head of the Army War College. A senior defense official said Petraeus is “far too high-profile for this to be a subtle thing.”

The board, composed of 15 Army generals, will examine a pool of more than 1,000 colonels to select about 40 brigadier generals, expected to lead the service over the next decade or longer. Although each board member has an equal vote on the candidates, Petraeus will be able to guide the discussion.

George Vecsey is the sports world equivalent of an inside-the-beltway political hack. Quoting his indignation concerning Barry Bonds is like quoting Chris Matthews on Hillary Clinton. The sporting hacks have never been able to stomach Bonds because he isn’t a “team player”; they long ago decided that he doesn’t belong. Swallowing wholesale what Vecsey says just to make some political analogy is, at best, lazy.

Because of all the contradictary statements on the blogosphere, I ended up calling Whiitehouse, Kohl’s and Feinstein’s offices between 3:00 and 3:30 pm yesterday. My question was could they explain to me what happend on the Judiciary votes, and why their Senator voted the way they did.

Whitehouse - voted against the Feingold amendment because he not only wanted the current law suits against the Telecoms to continue, he wanted Feingold wording to include denial of immunity to the Telecoms and Administration, and also wording for ACCOUNTABILITY. Whitehouse wants criminal charges brought against the Telecoms and the Administration for breaking the law in the first place, and he wants wording to force the Federal Courts to accept the cases.

Kohl- He believes the Telecoms were “acting in good faith” in “assisting” the Adminstration, and he wants wording that grants immunity to the Telecoms, but specifically states that the Adminstration is the defendent, not the telecoms, in ongoing and future law suits. (part of Specters abortion of a “compromise”)

Feinstein-Even though she is aware the Democratic “activists” are unhappy, she still voted against Feingold’s amendment. It is Feinstein’s intention to “work with Senator Spector” and make sure that the Telecoms are granted immunity - as is right since they were “merely helping the Government”. Feinstein also wants the Administration to be named as the defendant in the current lawsuits, but immunized against future suits and liability, since they were just protecting the country from “terrorists”.

Because of the varying pulls within just the Democratic side - Leahy performed a parliamentary manuever and simply excised ANY reference to immunity from the actual bill. That is how it got voted out of committee by all Democrats.

So it now goes before the FULL Senate, and Feingold gets to offer his amendment again, and Specter gets to do his usual sleazy “compromise” and exonerate the Telecoms and the Administration. Dianne Feinstein will be actively assisting Spector in his machinations and manipulations.

So Dianne Feinstien DID NOT actually change her “vote” nor position - she just kicked the can down the road to play out in the full senate, where she will have lots of Republican help.

The way I read it, is for all of us who like our fourth amendment rights, is to help Chris Dodd, by trying to line up 40 Senators who will commit to a filibuster, if we cannot get Harry Reid to honor Senator Dodd’s hold.

I didn’t make myself clear. The first news I got that Feinstein had changed her position was an e-mail from some Democratic group congratulating its members who’d lobbied her so intensely to change her position. Then I sent an e-mail to all of my pals in California congratulating them because I knew they’d called and e-mailed her office non-stop. So, my pleasure is with the people of California who worked hard to get her to change her vote.

You are so right — she doesn’t deserve congratulations for changing her vote on the issue.

But her constituents deserve a hearty slap on the back. I just hope that, by 2012 — when her term is up — she either retires or the California Dems can find a super candidate who can beat her in the primary.

I can’t wait for the movie. Perhaps the person who plays Valarie can think about how our government is so out of whack as she looks at that crooked floor in the Georgetown house where the party was held.

I also hope the movie plays up how cowardly people can be in government and in the social scene.

I’d also pick Clooney for Joe. Who would play Valarie? Please don’t say Nicole Kidman.

Btw, Joe has been portrayed in an HBO movie — “Live From Baghdad” — and very favorably, as the U.S. ambassador who protected and shepherded the Americans stuck and made hostages in Iraq. (That is a very good movie, if you don’t mind the political issues that don’t get discussed and get “into” the entertainment value and Michael Keaton’s great acting (!) as the CNN producer — it’s mostly about CNN’s coverage of the Gulf War — it leaves out some important contradictions (incl. the Iraqi soldiers/babies/incubator false story) that people protested, and which HBO corrected by adding an explanation at the end of the movie.)

There’s also a poignant portrayal of one of Saddam’s information ministers — the movie did a great job of humanizing him and the difficult position he held.

All the Republicans are dangerous because they’re all trying to out-machismo each other on killing Arrabbbs and Islamofascists and keeping Mexicans out of our country and protecting us from ourselves by destroying the Constitution. Joan Allen would be incredibly good because she’s such a fine actress — she can be made up/coiffed/dressed to look a lot more like Valerie (Hollywood artists can work magic that way) … Valerie’s portrayer needs to be a highly acccomplished actress. Preferably someone with a strong stage background who’s mastered acting. It’d be a crime if it goes to an actress who’s pretty but doesn’t have the experience acting that’s required for the part.

I haven’t seen “Michael Clayton” yet but the reviews I read all said that one of the reasons it’s such a fine movie is that the filmmakers did NOT go for the star/starlet as the female lead, but instead chose the acting master Tilda Swinton — not a natural beauty, but a powerful presence who captures the screen. (I saw her in an indy film a few years ago, and she was a haunting, powerful presence. That’s the kind of actress we need to play Valerie.)

The duo/directors of THE DEEP END, starring Tilda Swinton, would be great for this project: Scott McGehee and David Siegel are two of the best women’s directors of today, and would have a great feel for the material.
