Josh Marshall Doesn’t Seem to Understand Florida: Let Me Explain

Yesterday, TPM’s Josh Marshall or the “person who kidnapped Josh” (phrase from Lambert at Corrente) complains:

“…Then we have a speech like Sen. Clinton’s yesterday in Florida in which she compared the controversy over seating the Florida and Michigan delegates to the Florida recount debacle and many of the great voting and civil rights battles of the 20th century….

“What she’s doing is not securing her the nomination. Rather, she’s gunning up a lot of her supporters to believe that the nomination was stolen from her — a belief many won’t soon abandon….”

For months, in fact, many of us Floridians have drawn parallels between Recount 2000 and the DNC’s stripping Florida of 100% of its delegates — including some of my politically astute, Obama-supporting friends.

Hillary isn’t to blame for that sentiment — and it certainly didn’t result from a speech she made yesterday.

For the millionth time, Florida Democrats had no power to block the moving of Florida’s primary election. Thus, the DNC should not have “punished” Florida Democrats.

Our state legislature moved the primary dates, an entity on which the DNC’s rules are not legally binding. Our State House has about 77 Republicans to 43 Democrats. Republicans constitute about 60% of our State Senate.

In short, Florida Republicans can unilaterally pass or block any legislation they want. They could have moved the primary date without a single Dem vote.

Instead, they wanted Dems to go on record voting for it, so they tied the primary-date provision to a provision requiring paper trails for those touchscreen voting machines that ex-Sec. of State Katherine Harris had persuaded our big counties to buy.

For an idea of how well paperless voting has worked in Florida, see this article about paperless voting machines that reversed the results of a Medley, Florida, election in 2002 (scary stuff). Even better, the Equal Justice Foundation has a list of documented paperless voting-machine problems throughout the U.S.

The upshot: it is for very good reasons that Florida Dems wanted a paper trail, but state Republicans effortlessly blocked Dems’ efforts for years.

Last year, out of the blue, the Republicans decided to give the Dems their paper trail — but only if the provision was in the same bill that included the moving of Florida’s 2008 primary election.

Why, you may wonder, would our state Republicans do something like that? What could they possibly gain?

My guess is that they wanted the DNC to “punish” Florida Dems, which would in turn anger Florida’s Dem voters, which could in turn cause some of those Dems to stop donating money and to stay at home in November 2008 — or to vote for the party that ironically didn’t disenfranchise them this time around.

What other reason could there be, given that the Republicans had the numbers to unilaterally change the primary date and block the paper trail?

Think about it.

If that was Florida Republicans’ plan, then it obviously worked: the DNC reacted in the harshest way possible against their own voters.

Many of us Florida Dems are furious at the DNC for having done so — and would be whether Obama or Hillary were in the lead now.

Adding fuel to the fury, the DNC was not without a choice in its handling of Florida.

According to research printed at No Quarter, the DNC’s rules did not require the 100% stripping of Florida’s delegates — even if Florida Dems had intentionally moved the primary. Instead, the rules required a 50% stripping, and that’s only if Florida Dems had failed to act in good faith.

In fact, Florida Dems did act in good faith: they just didn’t have the power to bring about tangible results. This is a pitiful state of affairs with which we Floridians have lived for years (you can see evidence in our education system — one of the nation’s worst, despite our state’s relative wealth).

If you want background, Wayne Barrett published an accurate explanation at the Huffington Post of what happened in Florida — and of how the DNC reacted both irrationally and unfairly.

For reasons most of us Florida Dems don’t grasp, the DNC didn’t even listen to explanations by our state party leader, former Congresswoman Karen Thurman. Incidentally, she’s no longer in Congress, because state Republicans carved up her district during the 2000 reapportionment.

Giving credit where it’s due, our state Republicans are exceptional at strategizing.
As though there weren’t enough fuel in the fire, the DNC took the extra step of treating other states differently than Florida, showing leniency to New Hampshire, Iowa and South Carolina after they had moved their primary dates.

Many politically aware Florida Dems have known about all this for months, which is why so many of them now refuse to give the DNC money. Some even asked for refunds of their past donations.

Many Florida Dems are also considering becoming NPAs (our way of saying “Independents”) unless Florida’s primary is counted and new DNC leadership is installed.

And there is solid cause for Florida Dems’ resentment: given the facts and events, it’s obvious that the DNC intentionally disenfranchised Florida — with ears closed and eyes wide open.

Our own U.S. Sen. Bill Nelson talked about challenging the DNC’s decision last August, and the fury of Florida Dems has been building ever since.

That DNC “leaders” have refused to fix the Florida mess that they had caused — and that they had the nerve to suggest pretend solutions, like seating our state’s delegates after the nominee is chosen — has only stoked said resentment yet again.

In short, DNC “leaders” — themselves — caused the resentment that Florida Democrats now feel toward their own party and said “leaders” have insisted on continuing to exacerbate the situation. Now they want party unity?

It’s a shame that the entire nation may have to live with the consequences of a few people’s dismal decisions — unless Florida (our nation’s fourth largest state) ends up not mattering in November’s election. I guess we’ll see.

Memeorandum has commentary.

And, at the same time, give the other a thumbs down rating so Mr. O will move up to No. 1

DNC played right into the republicans hand, and they don’t even see it. This is not going away for Fl or Mi. Shun us now, and we will shun you down the road. You just don’t take away a peoples right to vote in our own Democracy, or take away our voice. These are sacred.

Comment by D. Cupples | 2008-05-23 13:53:40

Bingo: DNC did play right into FL Republicans’ hands. And don’t they look utterly foolish for having done so?

Comment by Blue | 2008-05-23 07:55:54

I have no doubt that many other Florida Democrats, such as myself, recognized the parallels, predicted the impending disaster, and waited hopefully for Hillary to stand up and speak for us as she did this week. Her speech was phenomenal.
Josh has absolutely lost it. I used to read him religiously, but not for some time now, and never again.

Comment by usedmeat | 2008-05-23 09:04:30

I stopped read his electronic rag after Greg Sargent chastised Hillary for demanding something to be done when that Dave Scheister called Chelsea a whore and Bill and Hill her pimps. I knew then that Toilet Paper Meme had lost all objectivity.

Hi Blue,

I didn’t realize that we’re fellow (disenfranchised) Floridians.

I know that my Floridian co-blogger at Buck Naked Politics and I were talking about parallels between Recount 2000 and the FL disenfranchisement a few months ago — so I suspect that others in our sometimes-great state were also.

Comment by Blue | 2008-05-23 14:48:44

I’ve been having to watch from out of state right now, but have no doubt that Florida will be handed to McCain on a silver platter, if Obama gets the ticket.
I’m headed back to the panhandle this weekend and expect to hear all about it!

E. Stoddard

Exactly right - take away my voice and I’m taking away my support.

Iowa, New Hampshire and South Carolina all broke the rules with no consequence. They all voted too early according to DNC by laws.

Yet Florida is stripped of all delegates. Shoot, the Republicans only took away half.

And the agreement the candidates signed was an agreement not to campaign here. Obama broke that rule but he doesn’t face any consequences either.

I am now proudly NPA.

Comment by D. Cupples | 2008-05-23 13:58:07

Lynne,

Interestingly enough, some FL legislators began talking about opening up our primaries — which would make it easier for Floridians to become NPAs.

I can’t help but wondering if our state Rs had this in mind all along. They really are good strategists.

One small correction: “the person who kidnapped Josh Marshall” is a phrase coined by the incomparable Bob Somerby of The Daily Howler. Lambert of Corrente and other pro-Hillary blogs have adopted it, in some cases as the initialism TGWKJM (G for “guy”).

What else would anyone expect of Howard Dean? Put him in the same socialist column as Obama and it is easy to see why the DNC is dead set on discounting Florida and Michigan votes that went for Clinton. The truth of the matter can be understood by understanding why Dean traveled to Europe to give the key note speech to PES (Party of European Socialist) back in 2006, Dec. 11. And Obama’s ties to communist activists. Both Howard Dean and Barack Obama are working for the same cause seeing as how the father of the communist party is also the father of the Socialist Party. Simply stated Both Dean and Obama are in the process of changing the democratic party as we now know it. This makes it easy to understand why Obama gets so many of the young college students when it is also understood that the schools are now saturated with the text books authored by the likes of William Ayers and his “Social Justice”.

I can always tell when Hillary’s continuing presence and power is evident. It brings out the worst of the bloggers for Obama. She is hitting the sweet spot on this, not because of her speech so much but rather because her speech resonates with voters.

That is what is bothering them.

As usual, they beg the question and attack her instead.

Apparently, Hillary has 13 supporters on the rules committee. Obama has 8. There are 7 who are neutral. I think I remembered the numbers right. Donna Brazile wants a compromise, but it must ensure Obama’s continued lead. *blink*

There is only one compromise I can think of that would be even remotely fair. Take away 50% but the delegates must represent the votes as cast. Otherwise, it is a farce.

Then the number required to win the nomination must be adjusted accordingly.

That’s the only compromise that is fair to voters.

Comment by workingclass artist | 2008-05-23 08:27:42

I believe there should be no compromise….SEAT FL/MI….the Voters have spoken….Obama’s strategy backfired on him now….and in Nov. if the DNC continues it’s suicidal irrational behavior…We will make the EXODUS OF REAGAN DEMOCRATS PALE IN COMPARISON….

Comment by D. Cupples | 2008-05-23 14:03:38

Ann,

You’re right: they’re bothered only because Hillary benefited from standing up for FL — while Obama will truly look illegitimate (NO play on words) if he wins the nomination without having fought for FL and MI.

Comment by Mary Ellen | 2008-05-23 08:17:00

If Obama will still be ahead in the delegate count if they count FL with their votes “as is” and MI with Hillary getting her votes and Obama not getting any because he took his name off the list, why is Dean so dead-set against allowing this to be resolved? His golden boy will still have more delegates, no? It way past time to fix this mess. I have the feeling that there was some kind of deal with the SD’s that Obama had to have a certain number above Hillary in order for them to vote for him and with FL and MI going to Hillary, he won’t be hitting that magic number. There has to be some kind of dirty deal going on.

Comment by AnninCa | 2008-05-23 08:32:02

As far as I can tell he is playing a semantics game. He and his minions continue to scoff at her popular vote win BECAUSE she includes MI and FL in the count. If he compromises before he reaches the 2026 number, he will not only have to move the goal to 2210 but he will also be behind in the popular vote count.

It’s all silly. These are metrics to evaluate “the will of the people.” In terms of the SD decision, all metrics should be considered as they try to determine the true will of the people.

And even the will of the people in such a tight race is pretty much a wash. 1/2 want him. 1/2 want her. It’s too tight to say definitively one way or the other.

Then the SDs should look at electability. That’s where he’s nervous. She is showing stronger than him in head-to-head polls in nearly all the key swing states and the must win states. He loses by today’s head-to-head polls to McCain. She wins.

That’s why the SDs aren’t yet jumping. And his talk in Florida with Jewish leaders? Omogid. Someone get the man off the trail. He talked to them like they were his youth group. “Don’t judge me by my name.” These are seasoned leaders in the community, and he thinks they are reading crap e-mails and thinking he’s Muslim? His other big point? “Be careful of judgment by association.” *blink* His statements are “I like Israel, too.” basically. That’s not going to cut it.

Hillary isn’t rallying the people on this issue. Hillary is listening to the will of the people on the issue and speaking for their cause.

There is a huge difference.

Comment by workingclass artist | 2008-05-23 08:53:35

Agree…Of course for the general I believe 1/2 of Obama’s current support will desert him as it was phony to begin with…Clinton commands 2/3 of the traditional base….The demographic Donna Putin told to Fuck Off…The New Demofascist Party don’t need em’…

Comment by D. Cupples | 2008-05-23 14:08:43

Mary Ellen,

I agree re: the dirty deal. The fact that Brazile and Dean have misleadingly spoken in public about FL is evidence enough that they don’t have facts on their side but do have a motive for disenfranchising FL.

I wish I knew the details. Maybe President Bush could get one of those Telecoms he’s so fond of to bug DNC headquarters (electronically, not the way that Nixon did it in ‘72).

Then again, Bush might want to share the democrat-enraging details but he wouldn’t, because he’d end up in prison.

I guess we’ll likely never learn what the DNC’s “leaders” really had in mind when playing the game as it has.

Comment by Seymour Glass | 2008-05-23 08:18:43

Then they added that Hillary could have all the senior citizens, they don’t need them in “their” party anymore.

How clueless are these people? If this is the attitude of these clowns, what’s going to happen to social security and prescription drug programs that the elderly depend on? Is Obama’s “new” party the “Solient Green” party? Get rid of the old to make room for the young?

The day after Texas, he looked glum. It was more than just a loss, it was that all his tactics were geared to shutting her out. A long campaign would only serve to hurt him.

And so it has.

And Ohio. There is a BBC interview with Samantha Power the day before the primary where she is openly gloating that he will win and be the nominee and using profanity, saying that she is stuck on the other side of the Atlantic to be not there for the big celebration.

There is only one logic and rationale driving Obama supporters on this issue that Obama will lose his case for the nomination; the fear it will weaken him and he won’t be the nominee is clouding their judgment. However, their case is already weakened if not more by their rallying cry to not count the votes — that does not work well in a Democracy, regardless of the candidates. Because of the gaming of the system and his artificial inflation of the delegate count, we now have a weaker nominee on our hands and a coward with no leadership. I fervently believe that if the roles were reversed, Clinton would have risked the nomination in favor of counting the votes — there is no way to know that but there is too much principle and legacy considerations here that she would have done the right thing. Obama is not worthy of the office he seeks.

I think the story is hilarious, though, in that the “gamer” is now faced with true grass-roots activism.

That just makes me smile. I did suggest to my buddy yesterday that when the WOMEN march this time around, I suggest we all wear bras. It might not be as cute as it was in the 70s at this stage of life. :)

GO PEOPLE WHO BELIEVE IN DEMOCRACY!

we now have a weaker nominee on our hands

CORRECTION: weaker self-proclaimed, presumptuous, nominee..

I was talking to our house guest — young guy who is not a citizen but has kept up with the election through largely from the media — he believed CNN when they ran the bit about majority of (pledged) delegates for Obama and the fake victory lap..Clinton has to take this to convention, if not for anything else but to set the record straight that he has not won anything yet and WIN the damn thing.

I can’t believe Josh Marshall and Marcos Moulitsas Zuniga are advocating disenfranchisement. They were Republicans in 1990s. Is this the new Democratic party?

This is far from over.

This is where this all has been leading since the Clinton team of Sosnick, Craig Smith, Maggie Williams and Ickes took over from the catatonic pair of Patty Doyle and Penn.

Since then we have won every state we needed to win - leading by 500,000 votes since feb.

When Obamas lawyer stopped the mi revote - over the amazing reasoning that it was unfair that those who had already voted in the gop primary couldnt vote AGAIN in the revoted dem primary - I saw this could be their campaign’s fatal mistake…

But only ‘IF’ Hillary was able to win TX,OH,IN,KY, WV…

Well…it seems she has….and since Obama stopped the MI revote - we now will fight to count that state as voted. There can be no “compromise”. The Obama campaign already showed this, the revote was the frigging compromise!

Because of Bauer’s dirty dealing -Hillary gets ALL her MI delegates and then we fight over the uncommitted!

This was and is the plan folks! The media dont get it - but this is why she has fought on - not to maybe be vp as the fools keep suggesting - but to get the majority of votes in the primaries and winning over the SDs.

The media may be with O’barry - but the wind and the tidal change is with US!

I suspect that FL’s energy may reignite MI, too.

Look for that next. Obama’s supporters managed to thoroughly throw water on them.

But FL is leading the way on this now.

Look for a spark of life in MI, too!

“the DNC should not have punished Florida Democrats”

OK, that might be correct.

When did Clinton decide that the DNC should not have punished Florida? When did Deb Cupples decide that the DNC should not have punished Florida Democrats?

Why didn’t anyone campaign in Florida if the ‘PROPER’ thing to do was to have the all the votes count?

I voted for Clinton on Super Tuesday. I vote for the Democrat this November but I don’t expect to ever vote for Clinton again.

Someone has gotten to Governor Patterson of New York who supports Hillary. I read that he has stated that Hillary is sounding desperate and she should stop trying to count Michigan and Flordia votes/delegates. Someone needs to talk to him to explain it to him. I don’t think he knows the full story. It would look bad if he switches to Obama. I am so disappointed in this election that if Hillary doesn’t get the nomination I will have to leave the democratic party forever. I am not proud of the DNC and party elites and how they have turned it into a circus. Reinventing new ways to prevent a candidate from being elected even when that candidate is superior to anyone else.

Send a message to the DNC by contributing $8.28 to Hillary’s campaign fund.  Why $8.28????  It will help send a message - “take it all the way to the convention!”

So how exactly did the Democratic members of the Florida legislature vote on moving the primary up? They voted for it, didn’t they? So there is no basis for saying that this forced upon the poor Florida Democrats, was there?

Grow up.

Perhaps you should read the article and all the articles the writer cites before formulating your unfounded opinion.

You are a low information voter. No wonder why you support Obama.

O/T
Larry, over at Rezkowatch:

in january 2006 obama was part of a congressional delegation to Iraq. He was only in Iraq for 2 days
and then “separated from the delegation to ’spend 8 dyas in Israel, Kuawait, Jordan and the Palestinian territories.’ The rest of the delegation went to Afghanistan and Pakistan without Obama.”

is this the time period for the soon-to-drop B.O. tape?

sorry if this has already been covered here.
